Terms of Use

The terms that govern your use of PrepNavigator.

Introduction

These Terms of Use ("Terms") govern your use of PrepNavigator, operated by PrepX Medical, Inc. ("PrepX Medical", "we", "us"). By accessing or using our Service, you agree to these Terms. If you do not agree, do not use the Service.

Section 1 — Service Description

PrepNavigator is a medical procedure preparation management platform designed for use by licensed gastroenterology and endoscopy centers ("Providers") and their patients. The Service provides:

  • Personalized procedure preparation instructions
  • Automated patient reminders
  • AI-powered preparation guidance
  • Real-time preparation compliance tracking for care teams
  • Secure patient portal for preparation instructions access

Section 2 — Eligibility and Access

Provider Access: Available only to licensed healthcare facilities and their authorized staff with valid credentials and two-factor authentication.

Patient Access: Available only to patients of enrolled Providers, verified via one-time passcode sent to the email on file with their Provider.

Prohibited: Access by unauthorized individuals, automated scraping, or use for any purpose other than legitimate medical procedure preparation management.

Section 3 — Important Medical Disclaimer

THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

PrepNavigator provides preparation instructions and guidance based on protocols established by your healthcare provider. Always follow the specific instructions provided by your physician or care team. If you have questions about your preparation, contact your healthcare provider directly. In case of medical emergency, call 911 immediately.

Section 4 — AI-Powered Features Disclaimer

PrepNavigator includes an AI-powered preparation assistant ("Prep Navigator Assistant") powered by Amazon Bedrock. This assistant:

  • Provides general procedure preparation guidance only
  • Is not a licensed medical professional
  • Cannot diagnose conditions or prescribe treatments
  • May not account for your complete medical history
  • Should not be used as a substitute for your care team's advice

For urgent medical concerns, contact your healthcare provider or call 911.

Section 5 — SMS Terms

By providing your phone number and consenting to SMS communications:

  • You agree to receive procedure preparation reminders and verification codes
  • Message frequency varies based on your procedure schedule
  • Standard message and data rates may apply
  • Reply STOP to opt out of all SMS messages
  • Reply HELP for assistance: support@prepnavigator.ai
  • SMS messages will never contain Protected Health Information

Section 6 — Acceptable Use

You agree NOT to:

  • Share your portal access credentials or passcode with others
  • Attempt to access another patient's preparation instructions
  • Use the Service for any purpose other than legitimate procedure preparation
  • Attempt to reverse engineer, copy, or reproduce the platform
  • Transmit malware, viruses, or harmful code
  • Use automated tools to access the Service

Section 7 — Intellectual Property

PrepNavigator, its design, features, and content are the exclusive property of PrepX Medical, Inc. Patent Pending. All rights reserved. The PrepNavigator name, logo, and associated marks are trademarks of PrepX Medical, Inc. Unauthorized use is strictly prohibited.

Section 8 — Privacy

Your use of the Service is subject to our Privacy Policy, available at prepnavigator.ai/privacy. By using the Service, you consent to our data practices as described in the Privacy Policy.

Section 9 — Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

PrepX Medical, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid for the Service in the 12 months preceding the claim. We are not responsible for clinical decisions made by healthcare providers or patients based on information provided through the Service.

Section 10 — HIPAA Compliance

PrepX Medical operates as a Business Associate under HIPAA and maintains appropriate safeguards for Protected Health Information. Healthcare providers using PrepNavigator must execute a Business Associate Agreement with PrepX Medical prior to use.

Section 11 — Termination

We reserve the right to suspend or terminate access to the Service for violation of these Terms, non-payment, or at our discretion with reasonable notice. Upon termination, patient data will be retained per HIPAA requirements and returned or destroyed per the applicable Business Associate Agreement.

Section 12 — Governing Law

These Terms are governed by the laws of the State of North Carolina. Any disputes shall be resolved in the courts of Guilford County, North Carolina.

Section 13 — Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated to Providers via email.
